The Rights of Immigrant Children and English Learners in the Public Schools

Immigrant children and English Learners (ELs) often face barriers in gaining entry to public schools and participating in school activities. This session will discuss what public schools can and cannot require of immigrant children and ELs. Topics to be discussed include Social Security numbers, immigration documents, birth certificates, immunization records, age requirements, the use of school district websites, and access to school lunch and breakfast programs. The session will also cover the rights of English Learners and their parents in the public schools. Additional topics will include Special Education and English Learners; Access to Post-Secondary Education for immigrant students; and the Deferred Action for Childhood Arrivals (DACA) program.

Roger Rosenthal

Roger Rosenthal, an attorney, is widely recognized as one of the foremost legal experts in the country regarding the rights of immigrant children and English Learners in the public schools. He is also considered the foremost legal expert in the U.S. regarding the Title I, Part C Migrant Education Program, outside of government. He served a two-year term as co-chair of the National Hispanic Education Coalition. He has dedicated his career to access to education and ensuring an opportunity to learn for all students. Mr. Rosenthal is the Executive Director of the Migrant Legal Action Program (MLAP) in Washington, DC, and serves as Executive Consultant to the National Association of State Directors of Migrant Education (NASDME).  He is a graduate of Yale College and Georgetown Law School.
